PRIVACY NOTICE FOR EVENTS AND ACTIVITIES
1. Who We Are
This Privacy Notice is issued by Tayag Ngochua & Chu (“TNC Partners”). TNC Partners is a personal information controller under Republic Act No. 10173,also known as the Data Privacy Act of 2012 (the “DPA”), its Implementing Rules and Regulations (the “IRR”), and relevant issuances of the National Privacy Commission (the “NPC”). TNC Partners independently determines how and why your personal information is processed.
This Privacy Notice explains how TNC Partners collects, uses, retains, shares, and protects your personal information in connection with our events and activities, including conferences, workshops, seminars, briefings, and similar engagements (collectively, “Events”), as well as any other interactions in which TNC Partners collects personal information from clients, prospective clients,business contacts, applicants, website visitors, or other individuals. From time to time, TNC Partners may co-host Events with its strategic partner, Mori Hamada & Matsumoto (“Mori Hamada”).
Nothing in this Privacy Notice is intended to diminish or replace the duty of confidentiality and privilege that attaches to communications between TNC Partners and its clients or prospective clients under applicable law and the rules of professional responsibility.
2. What Personal Information We Collect
Depending on the nature of your interaction with us, we may collect the following categories of personal information:
a. Fullname
b. Email address
c. Contact number(s)
d. Mailing address or office address (if provided)
e. Organization or company affiliation
f. Professional title or designation
g. Dietary requirements or preferences (if applicable)
h. Payment or billing information (if applicable)
i. Any other information you voluntarily provide during registration, at the relevant Event, in connection with our legal services or business engagements, or through your use of our website
We do not intentionally collect sensitive personal information (such as health information, religious beliefs, or government-issued identification numbers) unless strictly necessary and with your explicit consent. If you provided requirements that may reveal health or religious information, we will process such information solely for catering purposes.
3. How We Collect Your Information
We collect your personal information through:
a. Registration or sign-up forms (online or physical) for Events
b. Email or other correspondence relating to our Events
c. Information you provide at the Event venue (e.g., at the registration desk)
d. Photographs or videos taken during our Events (see Section 7 below)
e. Our website and any online platforms or portals maintained by TNC Partners
f. Business cards, meetings, referrals, and other professional interactions
4. Purposes of Processing
We process your personal information for the following purposes:
a. Event Registration and Administration
• Processing and confirming your registration
• Communicating with you about Event logistics (schedule, venue, changes)
• Preparing attendee lists and name badges
• Managing Event catering and venue arrangements
• Post-Eventfollow-up directly related to the relevant Event (e.g., distribution of event materials, feedback surveys)
b. Future Marketing Communications
• If you separately opt in, we may use your contact information to send you invitationsto future Events, legal updates and publications, newsletters, and other communications concerning the services or activities of TNC Partners. Your information may also be shared with Mori Hamada for similar communications, as described in Section 6 below.
• This is entirely voluntary. Your registration for and participation in the relevant Event is not conditional on your consent to receive marketing communications.
c. Client and Business Development
• Maintaining client and contact databases
• Responding to inquiries about TNC Partners’ services
• Internal record-keeping
d. Compliance and Legal Obligations
• Complying with applicable laws, regulations and legal obligations
• Establishing, exercising, or defending legal claims or rights
All collection and processing of your personal data shall be conducted in compliance with the principles of transparency, legitimate purpose, and proportionality, and shall be limited to what is necessary for each specific purpose.
5. Legal Basis for Processing
a. Event registration and administration. We process your personal information on the basis that it is necessary for the performance of a contract or for taking steps at your request prior to entering into a contract, namely, your registration for and participation inthe relevant Event. (Section 12(b), DPA)
b. Future marketing communications. We process your personal information for marketing purposes only with your express consent. You may give or withhold this consent freely, and your decision will not affect your registration or participation in the relevant Event. (Section 12(a), DPA; NPC Circular No. 2023-04)
c. Photographs and event documentation.We may take photographs or videos at Events on the basis of our legitimate interest in documenting and promoting our events, subject to your right to object. (Section 12(f), DPA)
d. Client and business development. We process your personal information for the legitimate interests of maintaining client and contact databases and responding to inquiries about TNC Partners’ services, provided that those interests are not overridden by your fundamental rights and freedoms. (Section 12(f), DPA)
e. Compliance and legal obligations. We may process your personal information when necessary to comply with a legal obligation to which TNC Partners is subject, or when processing is required by applicable law or regulation. (Section 12(c), DPA)
6. Sharing and Disclosure of Personal Information
Your personal information may be shared with or disclosed to:
a. Mori Hamada. TNC Partners may share your registration and contact data with Mori Hamada for the administration of the relevant Event and, where you have opted in to marketing, for Mori Hamada’s own marketing purposes. Mori Hamada is an independent personal information controller and processes your data in accordance with its own privacy notice.
b. Service providers. We may share your information with third-party service providers who assist with Event logistics, including venue operators and IT service providers. These providers process your data only on our instructions and are required to implement appropriate security measures.
c. No sale of data. We will not sell your personal information to any third party.
d. Legal requirements. We may disclose your personal information if required by law, regulation, or legal process, or if necessary to protect our rights or the rights of others.
e. Confidentiality. All personnel of TNC Partners are requiredto maintain the confidentiality of personal information that comes to their knowledge in the course of their work.
7. Photographs, Videos, and Event Documentation
Photographs and/or videos may be taken during our Events for use in:
a. Firm websites and social media channels
b. Marketing and promotional materials
c. Event reports and publications
If you do not wish to be photographed or recorded, please inform Event staff or contact us at privacy@tnc-partners.com. We will make reasonable efforts to accommodate your request.
8. Data Retention
We will retain your personal information only for as long as necessary to fulfill the purposes described in this Privacy Notice, or as required by applicable law. The following retention periods apply:
a. Registration data. A reasonable period after the relevant Event, or such longer period as may be required for legal claims or legitimate business purposes.
b. Marketing data. Until you withdraw your consent, after which your data will be securely disposed of within a reasonable period.
c. Client and business development data. For as long as the professional relationship remains active, or as required for legal claims or legitimate business purposes.
We will not retain personal information in perpetuity in contemplation of a possible future usethat has yet to be determined. When personal information is no longer required,it will be securely disposed of or anonymized in accordance with the DPA and its IRR.
9. Data Security
We implement reasonable and appropriate organizational, physical, and technical security measures to protect your personal information against unauthorized access,disclosure, alteration, or destruction. These measures are consistent with the requirements of the DPA, its IRR, and applicable NPC issuances.
TNC Partners also maintains the standards of confidentiality required of lawyers under the applicable rules of professional responsibility.
10. Scope and Method of Processing
We process personal information manually and/or electronically through registration systems, email and other correspondence platforms, contact databases, and related systems used to organize, administer, and follow up on our Events and Activities. Processing may include collecting, recording, organizing, storing,using, retrieving, consulting, sharing, updating, and securely deleting personal information, as appropriate for the purposes described in this Privacy Notice.
11. Your Privacy Rights
Under the DPA and its IRR, you have the following rights, subject to certain limitations provided by law:
a. Right to be informed of how your personal information is being processed
b. Right to object to the processing of your personal information
c. Right to reasonable access to, and to obtain a copy of, your personal information held by us
d. Right to rectification of inaccurate or incomplete personal information
e. Right to erasure or blocking of your personal information under certain circumstances
f. Right to data portability
g. Right to be indemnified for any damages sustained due to inaccurate, incomplete,outdated, false, unlawfully obtained or unauthorized use of personal information
h. Right to file a complaint with the National Privacy Commission if you believe your data privacy rights have been violated

12. How to Withdraw Consent
If you have consented to receive marketing communications, you may withdraw your consent at any time by:
a. Sending an email to privacy@tnc-partners.com with the subject line “Unsubscribe” or “Withdraw Consent”
b. Contacting us using the details in Section 13 below
Withdrawal of consent is free of charge and will be processed promptly. Please note:
a. With drawal of consent will not affect the lawfulness of processing carried out before the with drawal.
b. With drawal of marketing consent will not affect your registration for or participation in the relevant Event.
c. Withdrawal will apply to future marketing communications only.
